1. Engagement
You engage Us to provide cleaning and related services (Services).
2. Scope
We will perform Services as detailed in the Quote. Any additional work requested by You outside the original scope may incur additional charges. Changes to the scope will be agreed in writing.
3. Quote
Quotes are issued via MYOB and are valid for 30 days from the date of issue. Quotes include all cleaning products and equipment required to provide the Services.
4. Payment Method
Our preferred payment method is electronic bank transfer.
5. Interest and Late Payment Fee
If You fail to pay any amount due by the specified due date, We reserve the right to charge interest on the outstanding balance. Interest will accrue at a rate equal to the prevailing Cash Rate set by the Reserve Bank of Australia plus 2%.
6. Cancellation Policy
If You cancel a scheduled Service with less than 48 hours’ notice, a flat cancellation fee of $50.00 will apply.
7. Access
You are responsible for ensuring access to the property during the agreed hours for the Services. Failure to provide access could result in delays or additional costs.
Where We are provided with keys, access codes, or other security information to access Your property, You acknowledge that We will take reasonable precautions to protect the security of the property, but accept no liability for any loss or theft unless caused by Our proven negligence.
8. Cleaning products & Equipment
We will use products and equipment as specified in the Quote or as agreed upon in writing. If You have particular product preferences (e.g., eco-friendly products), these must be discussed and agreed upon before commencement of Services. Changes requested after work has begun may incur additional costs.
9. Client Responsibilities for Pre-Clean Preparation
You are responsible for ensuring that the areas to be cleaned are reasonably free of clutter, personal belongings, and obstacles. We will not be responsible for moving large furniture, valuables, or breakable items unless otherwise agreed in writing.
10. Health & Safety
We adhere to all applicable health and safety requirements.
10.1. You must inform Us of any hazards on-site prior to the commencement of work.
10.2. You are responsible for securing pets, children, and removing obstacles that may hinder work.
10.3. We reserve the right to not commence and/or suspend the Services if unsafe conditions are identified. Services will resume only once the conditions are resolved and could result in delays and/or additional costs.
11. Power & Water
You are responsible for ensuring safe access to power and water for the duration of the Services.
12. Pets
You must advise Us in advance if pets are present at the property. You are responsible for securing all pets during the Service. We will not be responsible for any injury to pets or damage caused by unsecured animals.
13. Damage Disclaimer
We take care to provide Services with due skill and care. However, We will not be liable for damage to items that are fragile, improperly secured, previously damaged, or that occur as a result of normal cleaning processes.
14. Materials Storage
During the course of the Services, We may store materials and equipment on-site. You are responsible for providing a safe and secure location for these items. We will not be liable for theft, loss, or damage to materials stored on-site.
You agree to ensure that stored materials, especially paints or chemicals, are kept safely away from children, pets, and flammable sources.
15. Disposal of Materials
All materials and equipment will be removed promptly after the project is completed, unless otherwise agreed in writing.
16. Inspection & Sign Off
Nearing completion of the Services and/or upon completion of the Services, You will be invited to inspect the work to ensure it meets the agreed standards and scope of work detailed in the Quote.
16.1. If minor defects or touch-ups are identified during the inspection, these will be noted and addressed promptly.
16.2. If You do not inspect the work or provide feedback, the work will be deemed accepted, and the final invoice will be due as per the payment terms.
16.3. Any issues arising after sign-off that are not covered under the Warranty will be considered a new service request and may incur additional charges.
17. Special Conditions (e.g., Floor Treatments)
If any special cleaning treatments (e.g., carpet steam cleaning, floor sealing) are provided, You must follow any aftercare instructions given to You. We will not be liable to rework or touch up should You fail to comply.
18. Warranty
We warrant the quality of our workmanship for a period of 14 days from the completion of Services. This warranty covers defects in the quality of cleaning resulting from Our failure to meet agreed service standards. It does not cover normal re-soiling, misuse, or environmental factors outside Our control.
19. Limitations of Liability
We take every reasonable precaution to ensure the quality and safety of the services provided. Our liability is limited to a refund of payments received from You and We, explicitly, will not be liable for any consequential, indirect, or incidental damages.
20. Force Majeure
We will not be liable for any failure to perform or delay in performing Our obligations under this Agreement due to events beyond Our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government-imposed restrictions, strikes, labour disputes, or equipment failure.
If such an event prevents or delays Us from providing the agreed Services, We reserve the right to reschedule or cancel the Agreement with a full refund of any payments received.
21. Indemnification
You agree to indemnify and hold Us harmless from any claims, damages, or expenses, including legal fees, arising out of or related to:
a. unsafe or hazardous conditions at the worksite that were not disclosed prior to the commencement of services;
b. damage caused by You, Your agents, or third parties during or after the provision of Services;
c. use or misuse of materials or equipment supplied by Us after the completion of the Services.
22. GST
If and when applicable, GST payable will be set out in Your invoice.
23. Severability
If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, that provision will be severed without affecting the validity or enforceability of the remaining provisions.
24. Assignment
Obligations under these Terms & Conditions may not be assigned without Our written consent.
25. Variation
These Terms & Conditions may not be varied except in writing signed by both parties.
26. Governing law
These Terms & Conditions are governed by the laws of South Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of South Australia.
27. Privacy & Confidentiality
You agree to allow Us to take photographs of the worksite before, during, and after the completion of Services for quality assurance and promotional purposes (e.g., website, marketing materials). If You do not consent to the use of these photos for promotional purposes, please advise Us in writing before Services commence.
28. Photography
You agree to allow Us to take photographs of the worksite before, during, and after the completion of Services. These photos may be used for quality assurance, record-keeping, and promotional purposes (e.g., social media, website, or marketing materials). We will ensure that any identifiable personal or property details are excluded or blurred. If You do not wish for these photos to be used for promotional purposes, please notify Us in writing prior to the commencement of Services.
29. Surveillance Cameras
You must notify Us if any surveillance cameras are operating inside the property during the provision of Services.
30. Conflict Resolution
In the event of a dispute, the parties agree to attempt informal resolution through negotiation. If the dispute remains unresolved after 14 days, the parties will participate in mediation with a neutral third party. If mediation fails, the parties may pursue their rights in court as governed by these Terms.
